Pennsylvania area attorney discusses common alimony guidelines
Attorney Jack A. Rounick of The Law Offices of Jack A. Rounick, LLC can help his clients with concerns regarding marital and family law. When issues arise such as the determination of alimony pendente lite (alimony or support during the pendency of the divorce) in Pennsylvania, many clients will ask their attorney about the guidelines used to conclude how much alimony should be paid to help support the other spouse when a separation or divorce begins.
Unfortunately, in the State of Pennsylvania, there are currently no guidelines set in place to determine the amount of alimony, if any, payable after a divorce. Alimony is set based on the need for rehabilitation of the dependent spouse. This may be paid to help a spouse re-enter the workforce after being a stay-at-home provider, or for the spouse to obtain a college degree to meet the financial needs required to support themselves (and children, if applicable) over time. The judge will take into consideration the income and budget of the marital team and then divide assets appropriately. Once this has been done, income and the ability to survive on their own terms will be taken into consideration when it comes to determining further payments and maintenance such as child support and alimony.
When it comes to spousal support, alimony during the litigation, the State of Pennsylvania is one of the very few that have specific statewide guidelines. These include a table that is based upon the Income Shares model and there are separate formulas used for calculating spousal support/alimony pendente lite and child support. However, alimony after a divorce does not have a specific formula and is determined on a case-by-case basis.
