Applying for child support
A complaint for child support must be filed with the court. If the mother of the child is not married, she will need to provide proof of the child's paternity. A parent with primary custody of the child is the custodial parent. The noncustodial parent pays child support to the custodial parent. A child support order can be modified at any time when there is a change in circumstances.
Modifying child support
Parents can petition the court for a review and modification of the child support order if there is a change in circumstances that can affect the child support amount. Each parent also can have the child support case reviewed every three years. Domestic Relations Sections of the court will send a notice to the parent and must review Temporary Assistance for Needy Families cases every three years. The purpose of the review is to increase, decrease, modify, or terminate the child support order. The following factors are considered:
- The child receiving support is 18 years old and/or graduated from high school, whichever last occurs.
- The child begins living with the noncustodial parent or someone other than the custodial parent.
- There is a significant increase or decrease of income for either parent.
- The noncustodial parent is incarcerated.
- There are significant or continuing medical expenses of the child
- Medical insurance and/or child care changes.
